This agreement is between Kustom By Kris, herein referred to as "KBK", and ______________________________________, herein referred to as “Consignor”.

Whereas Consignor wishes to sell merchandise as described on page 2 of this Agreement by consigning said item(s) to Kustom By Kris for sale, it is understood:

That KBK agrees to display item(s) in a prominent place in her establishment.

That KBK will make every attempt to obtain the best possible price for the consigned merchandise and will accept no less than $________________ as purchase price.

That for her efforts KBK is entitled to retain 30% of the purchase price.

That KBK will keep record online at kustombykris.com in a private account all sales activity for Consignor.

That should a sale be effectuated, KBK shall forward payment for the amount of the full purchase price less the aforementioned 30% via PayPal to Consignor within 30 days of the receipt of same.

That KBK will owe nothing to Consignor for any merchandise not sold at retail in her establishment.

That KBK represents that she maintains insurance for theft and damage, and that the consigned merchandise will be covered by said insurance while it is in her possession.

That Consignor agrees to leave the merchandise with KBK for a minimum of 90 days to begin on the date this Agreement is signed by KBK.

That should the merchandise remain unsold at the end of the consignment period and an election be made by the Consignee to remove said merchandise, any costs incurred by the delivery of same to Consignor shall be borne by Consignor.

Consignor warrants to KBK that the merchandise consigned pursuant to this Agreement are not in violation of any trademark, copyright, of other proprietary right of third parties, state or federal law or administrative regulation. Consignor hereby agrees to indemnify and hold harmless KBK from all damages, suits, litigation, awards and costs, including but not limited to attorney’s fees, which arise out of the display or sale of the consigned merchandise for any reason whatsoever, including but not limited to civil or criminal suits over the authenticity, legality, ownership, infringement of copyright or trademark or any other claim or litigation.

Consignor agrees to submit any questions or concerns over sales, payment, or other issues through the support system at kustombykris.com and not by contacting the store except to make arrangements to pick up unsold merchandise.
